Waiver

The undersigned client (hereinafter the “Client” or “You”) hereby agree to the following terms of this

Release Agreement (hereinafter this “Release”), all of which are required to participate in activities
offered by Reformed Pilates (hereinafter “Reformed Pilates,” “Us,” or “We”).

For participants under 18, a parent or legal guardian must sign this on behalf of the Client.

Physical Condition Pilates is a physical activity, in which You are voluntarily participating. You are participating with the knowledge, understanding, and risks inherent in any physical exercise, and you assume all risks of injury and even death, which could occur by participating. While We will work with Clients to make appropriate modifications, by attending a class, You represent and warrant to Us that you are in good physical condition and that You do not have any disability, impairment, or ailment that would prevent or inhibit your ability to participate in a Pilates class. We strongly recommend that you consent with a physician before beginning this exercise program.

We rely exclusively on You to communicate any conditions so that we can recommend modifications. You are also responsible to communicate to the trainer any pain that You experience during or after class. This allows Us to make modifications to exercises or the sequence generally.

Liability Waiver and Release Having read this Release, in consideration for being allowed to access the studio and participate in activities sponsored by Us, You, on behalf of yourself and my personal representative(s), assigns, and heirs hereby fully and forever release, waive, discharge, covenant not to sue, and hold harmless Reformed Pilates, its owners, employees, and contractors (collectively “Released Parties”) from all liabilities to You, Your personal representative(s), assigns, and heirs, for all loss(es) or damage(s) and any and all present or future claims, liabilities, or demands therefore, known or unknown, arising out of Your access to the studio and participation in activities sponsored by Us, even though such claim, liability or demand may arise out of the active or passive negligence or fault on the part of a Released Party or other participant.

You further agree that if, despite this Release, You, or anyone on your behalf, makes a claim against any Released Party, You will indemnify, defend, and hold the Released Party harmless from any such claim. You also acknowledge that there are risks associated with studio access and participation in activities sponsored by Us, including risks or dangers that are not readily foreseeable or presently known.

These risks may be caused, created, or exacerbated, in whole or in part by Your own actions or in actions, the actions or inactions of other participants, or the negligent acts or inactions by the Released Parties, and You hereby expressly assume all such risks and responsibility for any damage, liabilities, losses or expenses that You incur as a result of my participation. If You bring any guests to the studio, the scope of this Release shall be expanded to release, waive, discharge, covenant not to sue, and hold harmless all Released Parties from any claims, losses, or damages brought on behalf of the guest, as well as claims, losses, or damages attributed to the actions of any guest.

Children in the Studio We invite You to bring children and others to the Studio to observe a class, but with the understanding that the Studio does not offer any supervision of or childcare for such guests. Guests must either be self- sufficient, or capable of being safely watched by the Client during class. Clients are solely liable for the safety and actions of all Guests while in the studio. Any Guests who are disruptive or that we determine cannot be adequately monitored by the Client will be asked to leave. Clients will not be refunded any class credit or fees if they are asked to leave before the conclusion of class.

Images. We may periodically take photographs or videos of the studio, both during and outside of classes. By participating, you are allowing Us to use any photo or video containing your image. This Release shall constitute a limited license to use Your likeness, image, photograph, video in any media platform or format whatsoever, and to distribute, broadcast, and exhibit these without charge, restriction, or liability but only for the purpose of advertising or marketing Reformed Pilates.

Medical Authorization. By signing below, You authorize Us to administer and/or arrange for any medical assistance that we deem necessary or appropriate as a result of your presence in the studio, including without limitation, arranging transportation to a hospital or other medical facility.

Security. We are not responsible for any lost or stolen items, whether in the Studio or in parked cars. Clients should use care to secure all belongings, both in the studio and in cars.

Membership Our memberships are non refundable. Once you checkout with a subscription you agree to the subscription auto renewing on the same day of each month with your correct card on file. Once you checkout with a package you agree to the purchase and understand that we cannot refund your package if you change your mind on your purchase. Your subscription will auto renew until you decide to cancel your membership. You will get a renewal notice before your package renews each month. If you decide to cancel you may do that on your own or reach out to our staff to cancel for you by sending an email with your name, the name of your subscription and the date you would like us to cancel. We cannot be held accountable for your account deleting if your card fails to approve the purchase.

Cancellation Policy Clients may cancel a group class reservation with 12 hours’ notice. A reservation may be cancelled using the momence app or phoning the studio. (Leave a message if no one answers). The Client will be charged for the class as well as a $10 Late Cancel Fee if the cancellation notice was not provided at least 12 hours in advance and has occurred more than 3 times in a row. If you no show more than 3 times in one month we will charge you a $25 fee.

Minor Participants If this agreement is signed by a parent/legal guardian on behalf of a minor participant, You acknowledge that Pilates is a physical activity that carries certain inherent risks as described above. You acknowledge the rights waived by You, as well as the minor participant, as defined above. By signing this Release on behalf of a minor participant, You expressly acknowledge that the scope of the liability waiver and release described above includes a release on Your behalf as well as on the minor’s behalf.

All references to “You” in this Release shall be construed to refer to both the actual signer and minor participant. You further represent that You have authority to enter into this Release on behalf of the minor without further authorization or permission. Acceptance If any provision of this Release is held to be invalid or unenforceable in any respect for any reason, the validity and enforceability of such provision in any other respect and of the remaining provisions of this Agreement will not be in any way impaired.

I have read this Release, and I fully understand its terms and conditions. I understand that I am giving up substantial rights, including my right to bring an action against Reformed Pilates and/or the Released Parties. I acknowledge that I am signing this Release freely and voluntarily, and that I intend my signature to completely and unconditionally release the Released Parties to the fullest extent allowed by law.
